GENERAL CONTRACTING CONDITIONS

Claraboyas y ventanas Convex, S.L. is registered in the Madrid Mercantile Registry, Volume 38411 Book 0, Section 8, Sheet 172 page M683332, entry 1.

For your information, below are the General Terms and Conditions applicable to all our services of: sale, installation and placement and advice on skylights, roof windows and retractable stairs.

MINORS

This website and the services offered, are not directed to minors, so we explicitly ask minors to consult with their parents or legal guardians.

Minors are not authorized to use our services and should not, therefore, send us their personal data. However, in case of access to the published information, the minor will be accessing it under his/her own and exclusive responsibility.

In case Convex suspects or is aware at any time of the registration or contact of a minor under 18 years old, it will proceed to delete his/her data immediately.

BUDGETS

Convex’s commercial team will provide a free and personalized quote in relation to the specifications of each project. This implies that the client must provide us with all the information available to him prior to the elaboration of such proposal, which will be valid for 30 calendar days. Otherwise, the initial proposal can be modified later on at Convex’s discretion.

UNEQUIVOCAL ACCEPTANCE

After the approval of the estimate, the customer must make the agreed delivery on account, which will serve as a more formal signature regarding the acceptance of the proposal, as well as these General Terms and Conditions.

DELIVERY TIMES

A delivery time will be stipulated in each specific case, depending on the products purchased, as well as the form of delivery and or installation.

In no case, Convex will assume any penalty due to delays in the delivery of a product

PRICE

The price stipulated for each product will be determined by the offer or quotation passed on to the client, not including any work that is not explicitly indicated in the quotation.

PAYMENT METHODS

Payments in can be made by the different payment methods listed below:

Bank transfer.

In no case there is a surcharge on the price of the service to be paid by a certain payment method.

We only accept payments from accounts in the European Union (EU) and in no case assume costs for transactions.

RETURNS

Since Convex commercializes products, whether they are web page programming, mobile application development, consulting or online marketing services, it is not possible to accept returns once the services have started. However, under special circumstances, in case they have not been fully completed, the possibility of a partial refund will be considered, discounting the amounts corresponding to the work not yet done.

At no time will Convex refund expenses.

SUPPLIED DATA

Convex commits itself to maintain the confidentiality of all information made available by the customer, being obliged to keep the most absolute confidentiality of the data provided by the customer for the development of the service.

WARRANTY AND AFTER-SALES SERVICE

Convex offers in the skylights a guarantee for a period of 5 years from the date of supply in all the components of the same by default in its manufacture and 2 years in the electrical systems.

Defects caused by misuse of the client, in handling or erroneous installation or those produced by weather agents are exempt.

The replacement of any component will be carried out under the criteria of our technical department, the presentation of the original purchase invoice being essential.

LIMITATION OF LIABILITY

At https://www.convexsl.com we use the SSL (Secure Sockets Layer) protocol and all technical measures necessary to ensure the security of your data within our website and we do everything humanly possible to fulfil our obligations; however, in the event of a breach due to slight negligence or external attacks, our liability is limited to the direct and typical damage that was foreseeable in view of the nature of the goods, and we are not liable for material, personal or health damage to the customer or related persons where this is attributable to us.

This site and its components are provided for information purposes only. Convex is not responsible for the accuracy, usefulness or availability of any information transmitted or made available through it; it is not liable for any errors or omissions in such information.

The users of this page who provide their personal data, with the acceptance of the informed consent, renounce to any compensation that for the legal use of these data could correspond to them, not being able to exercise any legal claim for it. Should they wish to do so, they must not give up their data on this website.

FRAUDULENT USE

The customer is responsible for the proper use of its website, exempting Convex from any damage derived from fraudulent or criminal practices. Likewise, the client declares to make a proper use of the data provided by the users through its web page, according to the Internet laws and the provisions of the Organic Law 15/99 of December 13, 1999 on the Protection of Personal Data, and the General Regulation on Data Protection (RGPD), which came into force on May 25, 2016, exempting Anelis Network from any responsibility derived from the improper use of such data.

DATA PROTECTION

The personal data you provide will be included in manual and/or automated files owned by Convex. The purpose and destination of these files is the administrative and commercial management of the data they contain, as well as the provision of the requested services and other related ones described in this web page, as well as, if applicable, the transfer to third parties for the strict and exclusive provision of such services.

At any time the interested party may exercise their rights of access, rectification, cancellation, opposition and portability, as well as the right to forget their personal data by written request indicating their name, surname and address, addressed to Claraboyas y ventanas Convex, S.L., responsible for the files and their processing, with address at C/ Luis I nº80 – Pol. The present contract is formalized in Spanish.

UNDERSTANDING OF THE CONTENT

The customer acknowledges having read and understood these General Conditions before contracting the service, accepting these conditions in full.

DISPUTES AND JURISDICTION

In case of disputes and for the resolution of conflicts, both parties submit and renounce any other jurisdiction, to the courts and tribunals of Madrid, unless otherwise provided by law.

Although we are not obliged to participate in a dispute resolution procedure before a consumer arbitration body, the European Commission provides an online dispute resolution platform which can be found at http://ec.europa.eu/consumers/odr/.
